Accommodation Inventory Underwriting by the Promoter

The Promoter JAM Destinations Pvt Ltd having its office at Nagoa Bardez, Goa, 403516. guarantees to provide accomodation rights equivalent to the Holiday Credits/ weeks owned by the Purchaser during the entire tenure of the Membership, provided there are no dues payable by the Purchaser.

Credit Rights

The Purchaser shall be issued with an annual allowance of Weeks equivalent to the number of weeks owned as stipulated in “Particulars of Vacation Ownership” entitling the Purchaser to a right of occupation at the resorts covered by the program. Such a right exists for 25 Regular years for ‘Regular Membership’ . All rights, privileges and entitlements finish on the last year of use.

Free-Bees

This Membership does not include any free pick up & drop from any of rail stations / bus terminals / airports, nor any sightseeing tours, or any free breakfast or meal plan, However all these facilities can be arranged by Resort or its affiliates for a nominal fee. price may vary from Resort to Resort.

Calendar

The Club currently follows the Holiday Season Calendar as followed by the majority of the Industry Players.

The Management Charge

The Purchaser(s) shall pay an Annual Management Charge as a contribution to the upkeep and maintenance of the Inventory and the administration of the Club as specified in the Club Rules. It is due in advance on the 1st December each year for the following calendar year. It is variable in accordance with the terms of the Rules and the variance is linked to the Wage & Goods inflation. It will first become due on 1st December prior to the first Year of Activation as stated overleaf. The AMC is payable irrespective of the use of the holiday period. Non-payment of the Management Charge may result in the permanent cancellation of the defaulting Member’s Membership. It is payable every Year for the Regular Membership.

Choice of Resorts

As a member of the club the purchaser shall be entitled to request accommodation at the home resort or any of the resorts in the affiliation, subject to availability, A list of club Resort is provided The Club reserves the right to add or delete resorts in its portfolio as long as the occupation rights of the purchaser are secured and the new resorts added are of the same quality.

Associate Partners

In addition to the Destinations/resorts, members have access to all the resorts that are associated with the Club through their internal arrangements and TVC. Club Holiday Credits may be used to reserve accommodation at any of these resorts affiliated with TVC as per terms of booking. Club retains the right to alter/ change the exchange company at any point of time for better servicing of members. The member agrees and abides by these rights of the Club.

Default

In the event of the Purchaser failing to make any payment instalment on the due date(s) specified (time being of the essence) the Company shall be entitled to serve Notice requiring such payment to be made within 14 days. If the Purchaser fails to make payment then such failure shall constitute contractual default and all monies paid by the Purchaser shall be immediately and irreversibly forfeited to the Company. Liability for the balance shall remain with the Purchaser(s) and the Company reserves the right to revoke the membership.

Entire Agreement

It is understood that these terms and conditions along with the Purchase Agreement constitutes the entire contract of sale between the parties and no further matters not contained therein may be relied upon as forming part of this Agreement. No modification of this Agreement shall be valid unless made in writing and signed by both parties.

Intellectual Property

Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of WANDER VACATIONS and its licensors. Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of WANDER VACATIONS.

Final Agreement

This Agreement is legally binding and final. The Purchaser acknowledges that he enters into it of his own free will and it is neither rescindable nor cancellable and all monies paid are non refundable.
